Compliance: consent, PECR and UK GDPR

Our approach to UK marketing and data protection rules, written for the businesses that buy our leads and the people who want to know how their details are used.

Consent

How a homeowner agrees to be contacted, and the record we keep of it.

UK GDPR

Our lawful basis, transparency, and how people use their data rights.

TPS and CTPS

What the Telephone Preference Service registers mean for sales calls.

ICO

The UK data protection regulator, and how to raise a concern.

Every LeadsHunt lead starts with a homeowner who fills in an enquiry form asking for a quote, on one of the websites we operate under other brand names. Homeowners do not make enquiries on leadshunt.co.uk. Before they submit, the form tells them who will contact them about their enquiry and how, and they agree to it.

For every lead we record:

  • the date and time the homeowner submitted
  • the page and form they used
  • the exact consent wording they agreed to

Our privacy notice explains how we use homeowners' data.

PECR: calls, texts and emails

The Privacy and Electronic Communications Regulations (PECR) set rules for marketing by phone, text and email, and for cookies. In short:

  • Emails and texts to individuals for marketing need their specific consent, unless the soft opt-in applies, which covers a business's own customers. A homeowner's consent to be contacted about their quote is not consent to unrelated marketing.
  • Live sales calls must not be made to numbers registered with the Telephone Preference Service (TPS) unless the person has specifically agreed to calls from that caller.
  • Automated calls need specific consent.
  • Cookies that are not strictly necessary need consent. See our cookie policy.

We write our consent wording so that the installer who buys a lead can contact the homeowner about their enquiry, by the channels the homeowner agreed to.

TPS and CTPS screening

  • Even with consent, installers should keep their own do-not-call list and respect anyone who asks not to be called again.

UK GDPR and the Data Protection Act 2018

  • Controller: LeadsHunt is the controller of the personal data we collect, including homeowner enquiries made on the websites we operate under other brand names. Once a lead is delivered, the installer who bought it uses it as a separate controller.
  • Lawful basis: each use of personal data has a lawful basis, set out in our privacy notice.
  • One installer per lead: each homeowner's details go to one installer only, and are never resold. That keeps the number of businesses holding their data to a minimum.
  • Data minimisation: we only ask homeowners the questions an installer needs to quote. We do not ask about health, income or credit history.
  • Rights: homeowners and installers can ask to see, correct or delete their data, or object to its use. Where a request affects a lead we have sold, we tell the installer.

What buyers must do

When you buy a LeadsHunt lead, you agree in our terms and conditions to:

  • contact each customer only about what they asked about, and only in the ways their consent covers
  • follow PECR, UK GDPR and the TPS and CTPS rules in your own calling, texting and emailing
  • keep leads secure and never sell or pass them on
  • treat customers fairly, follow consumer protection law, and never suggest that a grant or finance is guaranteed or that you are part of a government scheme
  • tell us promptly about any complaint about how a customer was contacted

We do not give legal advice. Check your own sales and marketing process with your compliance adviser.

Other rules we follow

  • Who we sell to: we sell solar PV, battery storage and heat pump leads only to MCS-certified installers, boiler leads only to Gas Safe registered engineers, and double glazing leads only to installers registered with a competent person scheme. We sell business energy leads to energy suppliers, and to brokers signed up to a qualifying dispute resolution scheme. We sell equity release, mortgage and protection leads only to FCA-authorised firms and their appointed representatives with the right permissions. Section 3 of our terms and conditions sets out the full requirements for each programme.
  • Government schemes: LeadsHunt is not part of, or affiliated with, the Boiler Upgrade Scheme, the Warm Homes Plan, Ofgem or any government body.
  • Finance and insurance: LeadsHunt is not authorised or regulated by the Financial Conduct Authority. We do not give advice on, arrange or offer finance, mortgages, equity release or insurance. Our home energy and home improvement forms do not ask homeowners about finance. Equity release, mortgage and protection enquiries go only to FCA-authorised firms, as explained in the Regulatory information on those programme pages.
